Third DWI in St. Louis County With Blood Result

Aggressive DWI Defense

After being arrested, he agreed to submit to a chemical test of his blood and was taken to the hospital where a nurse drew samples.

With a few days of his arrest, the client hired me. This allowed me to challenge the suspension of his driver's license by filing a request for an Administrative Hearing with the DOR.

Criminal Case

Later he was charged with the Class E Felony DWI as a Persistent Offender. Client faced up to 4 years in prison, and revocation of his driver's license if he were convicted.

In the criminal case, I immediately set it for a Preliminary Hearing to force the State to show it had probable cause for the arrest.

Before the Preliminary Hearing, I challenged the prior DWI convictions used by the State to enhance this DWI to a Felony charge.

License Case

In the Administrative Hearing, I challenged the reliability of the blood tests results and won my client’s license case and the order for his license suspension was overturned.

In the end, the Felony charge in the criminal case was amended to a Misdemeanor. And in the Administrative Hearing the DOR agreed that the blood results were unreliable and excluded them from evidence and overturned the suspension of his license. My client was extremely happy.
